BUYING YOUR HOME IN SPAIN

Buying a house is likely to be the most expensive thing you´ ll ever buy. So it is vital you have a good and  trusted lawyer to make sure everything is in order.
Otherwise the consequences could be catastrophic.
We do not  corners but carry out a serious amount of work, some of which is pretty technical to make sure every base is covered for you.

What do we do for you?

We as your real estate lawyer,  make sure the contract is right and fair for you- so that you are fully protected and it covers all the issues important to you.  When we agree with the other side is done the “ exchange of contracts”

Before it we carry out the legal searching of the property, ensuring that the seller is actually the owner of the property and has provided to you all the necessary information of the property.  We check that the property has the licence on place ( planning searches for you) and the land registry confirms that there are not debts over the property

We organize the completion at the Notary, making sure that your Title Deeds joins all the legal requirement to be registered in your name as requested by the Land Registry. We are updated with all the Property new regulations to make sure that you are fully protected. The completion day is the day that you will receive your keys and therefore you will be able to move to your new house in Spain.

After moving in, we arrange for your new house to be formally registered in your name with the Land Registry.

Throughout all this we remain in regular contact with you, the other solicitor selling you the house or your mortgage company and the estate agents, doing all we can to ensure  the move to Spain  goes smoothly without any  risk for you.

IBI -Council Tax in Spain

IBI (Council Tax) in Spain

Who needs to pay for Council Tax?

If you own a property in Spain your Town Hall charges you a Local Tax annually which is called Council Tax or in Spanish  IBI.

How much do you have to pay?

This tax depends on  the  valor catastral of your property. For example two bedrooms appartment in Mijas could  be taxed aproximatelly  400€ anually and two bedrooms apparment  in Marbella could  be around 600€.

How can I pay for it?

It is very important that you register at the Town Hall your details in order for you  to pay the tax on time and being able to enjoy some discounts that some Town Hall could offer you.

I have been living in Spain , but I have never paid it. What problems could I have?

This a Local Tax that just for the fact of owning the property you have to pay. Therefore, the Town Hall will charge you interest and penalty fee for late payment. If you do not pay at all  they will acumulate few years debts and  they will  register an  embargo over your bank account. In case they do not find enough  money from it they will embargo your property.

What does means an embargo over my property?

In order to sell the property you need to release the embargo first. Therefore you will finally pay the debt, including all the interest and legal cost of the procedure. This will increase the debt in more than 40%.

What should I  do  in order to sort out my situation?

You could contact our legal team www.virginiaramos.com or info@virginiaramos.com,we could  register you at the Town Hall. We  could negotiate for you a payment plan and try to reduce  part of the debt for you.

Do you have to pay alimony in joint custody?

Do you have to pay alimony in joint custody?

It depends on the circumstances of each couple. In these  cases where there is equal  economic  status  each one  must pay the costs incurred by the minor while  the time with them and the extraordinary expenses equally between both. But it happens in some cases, there is  different economic status  between each  parent. It is then possible to establish as did the  Court judgment of Asturias  in it sentence os April 17, 2009, the requirement that the parent is better off pay a maintenance allowance to  the one who is  worse only the  periods when the child is with the contrary  parent. Or you can set each parent  pays the child  expenses  during the  periods that are in their  company  together with  a sort of quota in proportion to the  economic capacity of each parent to pay extraordinary cost like the father  pays 60% and 40% the mother or otherwise.
